From the supplier: A California Superior Court has ruled that the plaintiff in Portenier v. Republic Hogg Robinson, Inc may continue with her suit. The plaintiff is suing her former employer for assault and battery, claiming that her asthma worsened due to the secondhand smoke in the office. The court agreed that state workers' compensation law did not bar the claim since the tools of the plaintiff's trade had nothing to do with smoking.
