From the supplier: Defense counsel should argue against claims for damages for medical monitoring costs based on fear of disease in cases where the plaintiff is not ill at the time of the trial and there is less than a 50% probability that the plaintiff will develop the disease in the future. Counsel should argue that being any more generous with medical monitoring damages would be contrary to public policy, creating an unrestricted number of plaintiffs at huge societal cost.
